THE IMMUNITY RULE

The four year rule has increased significantly.

It’s been replaced by a new ten year time period.

Did you know that the time limits within which Local Planning Authorities can take enforcement action against certain breaches of Planning control more than doubled last year ? For Garden Rooms, this crucial timeframe has increased from four to ten years.

There is a transitional period in place for a breach that took place before 25th April 2024 but ten is now the important number. This means that obtaining a Lawful Development Certificate before you build your Garden Room will avoid potential problems if you decide to sell your property before 2035 !

Investing in a Garden Room can be a big decision and so it’s also useful to know that Permitted Development can’t be gained retrospectively.
